Alissa N. Winicki, lead counsel, in Deleon v. Estate of Raymon DeRanney, 2020 ONSC 19 (CanLII), fervently assisted her client, a then 17-year old girl, in making a claim for dependant relief pursuant to section 57 of the Succession Law Reform Act. Ms. Winicki successfully demonstrated that the deceased possessed a settled intention to treat her client, a non-biological and unadopted child, as a member of his family entitling her to a quantum of support.
The decision might help pave the way for unconventional family-types in making claims against a deceased’s estate for support.
