Do You Need an Advance Directive on Care Choices? We Can Help.

A Living Will, which is also known as an Advance Directive, is a document that indicates the grantor’s preferences with respect to health conditions and treatment, including the level of medical intervention he or she would like should he or she become incapacitated and cannot articulate these wishes. This includes if someone would like to be put on artificial life support and for how long. This document is intended to serve as a guide for the person who must communicate with physicians and make health care decisions in the event the patient is not able to do so him or herself.

An Advance Directive can be very detailed and tailored to the individual’s personal circumstances. A Power of Attorney for Personal Care (which names a specific person who can act on your behalf as attorney over matters concerning medical treatment and personal care generally) can otherwise be used to substitute a more comprehensive Advance Directive in which case it is not as necessary to articulate each and every health care related instruction. Typically, our office customizes Powers of Attorney for Personal Care to encompass both a general directive to the acting attorney as well as a few specific directives which instruct both the attorney and any third-party health providers. Be sure to make the preparation of either or both an Advance Directive and Power of Attorney for Personal Care a priority in achieving your comprehensive Estate Plan.
